Construction Manager-At-Risk and RFP

Drymalla Construction Company has been selected by the Smithville ISD Board of Trustees to be the Construction Manager At-Risk for the construction of the Multi-purpose Athletic Complex and the new Smithville Junior High Campus.






Sealed proposals will be received by Dr. Rock McNulty, Superintendent of Schools, Smithville Independent School District (the “District”), P.O. Box 479 and 901 N.E. 6th Street, Smithville, Texas 78957, until 2:00 p.m., Thursday, May 4, 2017, at which time they will be publicly opened at the street address of 901 N.E. 6th Street, and the names of the offerors, and the fees and prices, if any, stated in each proposal read aloud as the proposals are opened, to provide Construction Management at-Risk (“CMAR”) services for the following: (1) the New Junior High; (2) the New Multipurpose Athletic Complex; or (3) both the New Junior High and the New Multipurpose Athletic Complex. The CMAR (one or two providers, at the District’s discretion) will be expected to provide services for the design phase, bid/award phase, and construction phase of the Project contracted.

The budget for the New Junior High and New Multipurpose Athletic Complex (including all design fees and soft costs) is $29,500,000.00. The total construction budget is estimated to be $20,432,500.00. The estimated construction budget for the New Junior High is $15,170,000.00. The estimated construction budget for the New Multipurpose Athletic Complex is $5,262,500.00.

The District has selected O’Connell Robertson, as the Architect.

The firm(s) selected will provide the CMAR services for the following:

          (1) New Junior High to:
                       a. Serve approximately 500 6th-8th grade students in one building with secure main entry; and
                       b. Provide classrooms, science lecture/labs, band hall and support space, special education area, library/media    center with computer lab, cafeteria with kitchen and UIL-compliant stage, UIL-compliant gymnasium, and offices.
               The New Junior High will be built on the high school site to allow for sharing of resources and parking.
          (2) New Multipurpose Athletic Complex to:
                      a. Serve the high school and New Junior High to provide on-site access for PE, practice and competitions;
                      b. Stadium to include grandstand seating for 5,000, a UIL-compliant 400M track, ticketing, concessions, press box,   meeting room, locker room, storage and restrooms;
                      c. Support the New Junior High and the high school football, soccer, track, band, cheerleading, PE and District-wide  special events; and
                     d. Improve ADA access to District athletic facilities.
               The New Multipurpose Athletic Complex will be built adjacent to the New Junior High and the high school.

The construction schedule is anticipated to provide for:
          (1) Substantial Completion of the New Junior High: July 2019 for use in the 2019-2020 school year; and
          (2) Substantial Completion of the New Multipurpose Athletic Complex in July 2018.

The firm(s) selected will be required to enter into a contract utilizing the Owner/Construction Manager Agreement, AIA Document A133-2009, Standard Form of Agreement Between Owner and Construction Manager as Constructor where the basis of payment is the Cost of the Work Plus a Fee with a Guaranteed Maximum Price, as modified by District, and AIA Document A201-2007, General Conditions of the Contract of Construction, as modified by the District, and to furnish Performance and Payment Bonds through an approved bonding company duly authorized to do business in the State of Texas and currently listed in the Department of Treasury Federal Register in an amount of not less than 100% of the contract price, conditioned upon the performance of the contract, provide insurance as set forth in the procurement package and contract, and meet all other requirements set out in the Request for Proposals and resulting contract(s).

Attention is called to required compliance with all Federal, State and local labor laws, including Chapter 2258, Texas Government Code, Title 10, and the prevailing minimum wage rates as set by the Smithville ISD Board of Trustees.

All parties acknowledge the right of the District to reject any or all of the Proposals and to waive any informality or irregularity in any Proposal received. By submitting a Proposal (or Proposals), each offeror agrees to waive any claim it has or may have against the District, the Architect/Engineer and their respective employees arising out of or in connection with the administration, evaluation or recommendation of any Proposal; waiver of any requirements under the Proposal Documents; acceptance or rejection of any Proposal; and award of Contract(s).

Pursuant to the provisions of the Texas Government Code Chapter 2269, Subchapter F, it is the intent of Smithville ISD to select its CMAR (one or two providers) via a ONE STEP PROCESS.

Box 479, Smithville, Texas 78957. The Request for Proposals includes important information for consideration. There will be a pre-proposal meeting (it is not mandatory) on Wednesday, April 26, 2017 at 10:00 a.m. at 901 N.E. 6th Street, Smithville, Texas 78957. Please also note that Offerors will be interviewed during a posted school board meeting, which is anticipated to occur during the week of May 8, 2017. Offerors will be provided each Offeror’s exact interview date and time.
